Terms of Service

Important Medical Disclaimer

mediCare is a technology platform that facilitates telemedicine services. It does not replace emergency medical services. If you are experiencing a medical emergency, call your local emergency number (e.g., 911) immediately. Do not rely on this platform for emergency care.

1. Acceptance of Terms

By accessing or using the mediCare platform ("Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our HIPAA Notice of Privacy Practices. If you do not agree to these Terms, you must not use the Service.

You must be at least 18 years old to create an account. If you are under 18, a parent or legal guardian must register on your behalf and accept these Terms.

2. Description of Service

mediCare provides a digital platform that enables healthcare providers to deliver telemedicine consultations, manage patient records, schedule appointments, issue prescriptions, process referrals, and communicate with patients. The Service includes but is not limited to:

  • Secure video and text-based consultations
  • Electronic health record (EHR) management
  • Appointment scheduling and automated reminders
  • E-prescribing and prescription management
  • Provider-to-provider referral workflows
  • Health analytics and reporting dashboards
  • Integration with DHIS2 and other health information systems

3. User Accounts and Responsibilities

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to:

  • Provide accurate, complete, and current information during registration
  • Promptly update your information if it changes
  • Use strong, unique passwords and enable multi-factor authentication
  • Notify us immediately of any unauthorized access to your account
  • Not share your login credentials with any other person
  • Not create multiple accounts for a single individual

4. Healthcare Provider Terms

Healthcare providers using the platform represent and warrant that they hold all necessary licenses, certifications, and credentials required to practice medicine or provide healthcare services in their jurisdiction. Providers are solely responsible for:

  • The clinical care, diagnoses, and treatment decisions they make through the platform
  • Maintaining appropriate malpractice insurance coverage
  • Complying with all applicable medical practice laws, regulations, and professional standards
  • Ensuring informed consent is obtained before delivering telemedicine services
  • Accurate and timely documentation of patient encounters

mediCare does not practice medicine, provide medical advice, or make clinical decisions. The platform is a technology tool that facilitates the delivery of healthcare services by licensed professionals.

5. Prohibited Conduct

You agree not to:

  • Attempt to gain unauthorized access to any part of the Service, other accounts, or systems
  • Use the platform to provide medical services without appropriate licensure
  • Transmit malware, viruses, or any harmful code
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated tools (bots, scrapers) to access the Service without authorization
  • Share, sell, or distribute other users' personal or health information
  • Use the Service for any illegal purpose or in violation of any applicable law
  • Misrepresent your identity, qualifications, or affiliation

6. Intellectual Property

All content, software, designs, trademarks, and other intellectual property associated with the Service are owned by mediCare or its licensors. You may not copy, modify, distribute, or create derivative works from any part of the Service without prior written consent. Your health data remains yours — we claim no ownership over your personal health information.

7. Payment and Billing

Certain features of the Service may require payment. By using paid features, you agree to pay all applicable fees. Payment terms, refund policies, and subscription details are provided at the point of purchase. We reserve the right to change pricing with 30 days' notice.

mediCare is not a health insurance provider. Consultations and services delivered through the platform may or may not be covered by your insurance plan. You are responsible for understanding your coverage and any out-of-pocket costs.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDICARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. THIS INCLUDES, BUT IS NOT LIMITED TO, DAMAGES FOR LOSS OF DATA, LOSS OF PROFITS, OR INTERRUPTION OF SERVICE.

mediCare does not guarantee the accuracy of any clinical information, diagnoses, or treatment recommendations provided by healthcare professionals through the platform. Clinical responsibility rests solely with the licensed healthcare provider.

Our total aggregate liability to you for any claim arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Termination

You may deactivate your account at any time through your account settings or by contacting support. We may suspend or terminate your access if you materially breach these Terms, with notice where practicable.

Upon termination, your right to use the Service ceases immediately. However, we will retain your health records as required by applicable medical record retention laws. You may request export of your data prior to account deletion.

10. Dispute Resolution

Any disputes arising from these Terms or the Service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction. Class action lawsuits and class-wide arbitration are not permitted.

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

11. Changes to These Terms

We may revise these Terms at any time. We will provide at least 30 days' notice of material changes via email or platform notification. Continued use after the effective date constitutes acceptance. If you disagree with the changes, you must stop using the Service and deactivate your account.
